We at OpenPlacement, Inc. ("Company", "we", "us", "our") take the privacy of our users ("you", "your") seriously. Please read the following to learn more about our Privacy Policy. By visiting or using the Services (defined below) in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy, and you hereby consent that we will collect, use, and share your information in the following ways. What Does This Privacy Policy Cover?

This Privacy Policy covers the information that we may collect or receive across the Internet and other digital formats from users who (a) access or use openplacement.com, (b) access or use our software applications, and (c) receive email messages from us (collectively, the “Services”). This Privacy Policy does not apply to information we collect by other means (including offline) or from other sources.

Users of our Services may include, without limitation, care providers, care recipients (e.g., patients or individuals seeking the services of care providers or medical-related products), continuing care professionals (e.g., case managers and discharge planners), and content contributors.

This policy does not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage.

Collection of Personally Identifiable Information

Personally Identifiable Information is information that identifies you as an individual. Through the Service we collect Personally Identifiable Information that you knowingly provide us, such as:

  • name,
  • account user name,
  • email address,
  • physical address, including place you may be receiving care, if applicable, and
  • phone number.

If you are a care provider and sign up for our subscription services, we will also collect your credit card information and billing address.

If you are a care recipient or a continuing care professional acting on behalf of a care recipient, we may collect other information about the care recipient and combine it with Personally Identifiable Information, such as:

  • gender,
  • date of birth,
  • medical or health related products and services that a care recipient may request, and
  • the care recipient’s preferred method of payment for such products and services.

In addition, in some cases, when we partner with hospitals we may collect the following information about care recipients and combine it with Personally Identifiable Information:

  • unique patient identifier,
  • medical and health conditions, and
  • type of medical or health services required by a patient.

We will treat all such information as Personally Identifiable Information as long as it is combined with Personally Identifiable Information.

You may also provide information to us when contacting us and when providing information in the public areas of our Service such as our message and discussion boards.

You may choose not to provide us with certain Personally Identifiable Information, but then you may not be able to register with us or to take advantage of some of our Services. For example, if you are a patient or a discharge planner and you would like more information about a care provider or if you are a care provider signing up for a subscription plan, you must provide your name, email address, and phone number. If you would like to respond to a public question posted on our Q&A pages, you must provide us with your name and email address.

Use Of Personally Identifiable Information

We and our third party service providers may use Personally Identifiable Information collected from the Service:

  • to provide the Services to you,
  • to personalize the Services,
  • to set up your user account and profile,
  • to respond to your inquiries and fulfill your requests for certain products and services,
  • to request information on behalf of a care recipient through the Service,
  • to complete and fulfill your purchase to have your payments processed (including credit card payment), communicate with you regarding your purchase and provide you with related customer service,
  • to track whether the Services have met the needs of our users,
  • to send administrative information to you such as information regarding the Services and changes to our terms and policies and to otherwise contact you for purposes of providing the Services,
  • to send you notifications via email, voice mail and text message in connection with providing and promoting the Services,
  • for our business purposes, such as data analysis, audits, fraud monitoring and prevention, developing new products, enhancing, improving and modifying our Services, identifying usage trends, determining the effectiveness of our promotional campaigns and operating and expanding our business activities,
  • as we believe necessary or appropriate: (a) under applicable law; (b) to comply with legal process; (c) to respond to requests from public and government authorities; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain, and
  • to send you surveys and feedback requests that will allow us to improve our Services,
  • to send you marketing communications that we believe may be of interest to you, including promotional offers on behalf of other businesses.

We may also anonymize your Personally Identifiable Information so that you cannot be individually identified and aggregate it with other information. We may use that information to analyze and improve the Services.

Sharing of Personally Identifiable Information

We may share the Personally Identifiable Information collected from the Service as follows:

  • among our affiliates for the purposes described in this Privacy Policy,
  • to our third party service providers who perform tasks on our behalf so that we may provide the Services to you, such as payment processing, order fulfillment, and website hosting; provided that these third party service providers do not have any right to use the Personally Identifiable Information we share with them beyond what is necessary to assist us,
  • directly by you in public areas of the Service such as on public discussion pages, message and comment boards, question and answer boards, chat boards and blogs, which will allow the general public to see your information and contact you through messages, answers or comments,
  • directly by you when you request more information about a care provider specifically (i.e., if you are a care recipient requesting more information about a care provider listed on our Service, then that care provider will receive your information and may contact you, and in some cases other similar care providers or service providers may receive your information and may contact you, even if your phone number appears on a state or federal Do Not Call list),
  • directly by you when you request more information about care service providers in general (i.e., if you are a care recipient requesting general information about care services, then you may be contacted by one of our third party service providers regarding your request even if your phone number appears on a state or federal Do Not Call list),
  • indirectly by you when you authorize a continuing care professional (such as a discharge planner at a hospital) or other individual (such as a family member) to request more information about a care provider on your behalf,
  • directly by you when you create a public user profile (i.e., user profiles are created by care providers to facilitate user interaction with the Services),
  • to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings), and
  • as we believe necessary or appropriate: (a) under applicable law; (b) to comply with legal process; (c) to respond to requests from public and government authorities; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.

We may anonymize your Personally Identifiable Information so that you cannot be individually identified, and provide that information to our partners.

Retention of Personally Identifiable Information

We will retain your Personally Identifiable Information for as long as your account is active or as needed to provide you services and for the period necessary to fulfill the purposes outlined in this Privacy Policy, unless we are required by applicable law to retain such information for a longer period of time.

Collection of Other Information

“Other Information” is any information that is linked or reasonably linkable to a particular computer or device, but does not reveal your specific identity or directly identify any individual, including the following:

  • browser and device information,
  • time spent on the Services,
  • pages visited,
  • response times to messages received,
  • how often a care provider shows up in search results,
  • number of profile views of care providers,
  • language preferences,
  • clicks on links,
  • your unique mobile device,
  • demographic information, including gender of care recipients and precise physical location,
  • IP address (a number automatically assigned to the computer or device that you are using by your Internet Service Provider), and
  • Various aggregated information.

We and our third party service providers may collect Other Information in a variety of ways, including through your interaction with the Service; your browser or device; your mobile device identifier; the use of pixel tags and other similar technologies; your IP address; the aggregation of information; and cookies (cookies are pieces of information stored directly on the computer that you are using).

You may be able to change the preferences on your browser or mobile device to prevent or limit your computer or device’s acceptance of cookies, but this may prevent you from taking advantage of some of our Service’s features. If you click on a link to a third party website, such third party may also transmit cookies to you. This Privacy Policy does not cover the use of cookies by any third parties.

Use Of Other Information

We and our third party service providers may use Other Information collected from the Service:

  • to operate, improve, analyze and manage the Services,
  • to ensure the Services function properly,
  • to track the actions of users of the Services to understand how the Services are used and to improve the design and functionality of the Services,
  • to measure and report on the success of marketing campaigns,
  • to calculate usage levels of the Services, helping diagnose server problems and administer the Services via your IP Address,
  • to provide you with personalized location-based services and content, including promotional content and advertising, through the use of your device’s physical location (where permitted by law),
  • for security purposes, to facilitate navigation, display information more effectively, and to personalize your experience while using the Services, and
  • as we believe necessary or appropriate: (a) under applicable law; (b) to comply with legal process; (c) to respond to requests from public and government authorities; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.

We may also partner with certain third parties to collect Other Information to engage in analysis, auditing, research, and reporting, as well as to deliver services, including advertising services, that we believe may interest you based on your activity on our Service and other websites over time. These third parties may set and access cookies on your computer or other device and may also use web logs or web beacons. This Privacy Policy does not cover the use of cookies by any third parties.

At this time, we do not honor "Do Not Track" headers and similar mechanisms.

When we collect usage information (such as the numbers and frequency of visitors to the Services), we only use this data in aggregate form, and not in a manner that would identify you personally. For example, this aggregate data tells us how often users use parts of the Services, so that we can make the Services appealing to as many users as possible.

Sharing of Other Information

We may share Other Information collected from the Service as follows:

  • among our affiliates for the purposes described in this Privacy Policy,
  • to our third party service providers who provide services that enhance our Services,
  • to our third party partners (e.g., care providers who may use aggregate information such as number of profile views and number of inquiries and calls, to understand how often and in what ways people use the Services so that they can provide other users of the Services with an optimal experience),
  • to our advertising partners to allow them to choose demographic information of users who will see their advertisements and/or promotional offers (e.g., we may use the fact that you are located in San Francisco to show you advertisements or offers for San Francisco businesses, but we will not tell such business who you are), and
  • as we believe necessary or appropriate: (a) under applicable law; (b) to comply with legal process; (c) to respond to requests from public and government authorities; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.

In some instances, we may combine Other Information with Personally Identifiable Information (such as combining your name with your geographical location). If we combine any Other Information with Personally Identifiable Information, the combined information will be treated by us as Personally Identifiable Information as long as it is combined.

Security of Personally Identifiable Information

If you created an account with us, your account is protected by a password that you created. You must prevent unauthorized access to your account and Personally Identifiable Information by selecting and protecting your password appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account.

We endeavor to protect the privacy of your account and other Personally Identifiable Information we hold in our records, but we cannot guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

The Services may contain links to other sites. We are not responsible for the privacy policies and/or practices on other sites. When following a link to another site you should read that site’s privacy policy.

When you enter credit card information through our Service, our third party service provider encrypts that information once it is entered.

Sensitive Information

We ask that you not send us, and you not disclose, any sensitive Personally Identifiable Information (e.g., social security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, criminal background, or credit card number or payment information unless necessary to make a purchase) on or through the Services or otherwise to us.

Third Parties

This Privacy Policy does not address, and we are not responsible for, the privacy, data use and disclosure, information or other practices of any third parties, including our third party service providers, or any care providers, continuing care professionals, hospitals, physicians or other individuals or entities accessing or using our Services, or any other third party operating any site or service to which the Services link. The inclusion of a link on the Services does not imply endorsement of the linked site or service by us or by our affiliates.

You should always read the privacy policy of any website you access or social network page through which you share information carefully in order to understand their specific privacy and information usage practices.

What Personally Identifiable Information Can I Access?

Through your account settings, you may review, correct, update and otherwise access, and, in some cases, edit, suppress or delete the following information you have provided to us:

  • Name and password,
  • Email address,
  • Location,
  • Address, and
  • User profile information of care providers, including images and videos and any other information describing senior care needs that you have uploaded to the Service.

In some cases you may also view the following, if applicable: the care providers selected, health and medical conditions identified, communications among users, and the last four digits of your credit card number.

The information you can view, update, and delete may change as the Services changes. When you update information, however, we may maintain a copy of the unrevised information in our records as required by applicable law.

We may use any aggregated data derived from or incorporating your Personally Identifiable Information after you update or delete it, but not in a manner that would identify you personally.

What Choices Do I Have?

You can always opt not to disclose information to use, but keep in mind some information may be needed to register with us or to take advantage of some of our special features. See “Collection of Personally Identifiable Information”.

If you do not want to receive email or other mail from us, please indicate your preference by logging into your profile and changing your contact preferences or contact customer support at www.openplacement.com/support or [email protected]. You may also opt-out of receiving marketing related emails by clicking on the opt-out link within the email message that you receive from us.

If you would prefer that we do not share your Personally Identifiable Information on a going forward basis with our affiliates for their direct marketing purposes, you may opt-out of this sharing by contacting us at [email protected].

Please also note that if you do opt-out of receiving marketing-related emails from us, we may still be required to send you administrative messages relating to the Services from time to time.

Use of Plaid

OpenPlacement uses Plaid Technologies, Inc. ("Plaid") to gather your data from financial institutions. By using our service, you grant OpenPlacement and Plaid the right, power, and authority to act on your behalf to access and transmit your personal and financial information from the relevant financial institution. You agree to your personal and financial information being transferred, stored, and processed by Plaid in accordance with the Plaid Privacy Policy.

Use of Services by Minors

Our Services are not intended for or directed to individuals under the age of 13. We request that these individuals not provide any information through any of the Services. In the event that we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible. Changes to this Privacy Policy

We may make changes to this Privacy Policy from time to time. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used. If we make changes in the way we use Personal Information, we will notify you by posting an announcement on our Services or sending you an email. Any changes will become effective when we post the revised Privacy Policy on the Services, unless otherwise specified. Unless otherwise specified, you are bound by any changes to the Privacy Policy when you use the Services after such changes have been first posted.
